19 States File Lawsuit Over The Reallocation Of Funds For The Trump Administration’s Border Wall…


19 states have joined forces in suing the Trump administration over its supposed reallocation of $3.8 billion in defense funds to the border wall.

The 19 states are arguing that the new allocation is unconstitutional because it violates the separation of powers and is also a violation of the appropriations clause which states:

“[n]o Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law.” The Appropriations Clause is a “straightforward and explicit command” that “no money can be paid out of the Treasury unless it has been appropriated by an act of Congress.”

The lawsuit also goes on to state that environmental harm will be caused to some of the border states, including “the blocking of wildlife migration, flooding, and habitat loss” in New Mexico.

The law suit was filed in federal court in California on Tuesday.
