The American Civil Liberties Union of Alabama and Planned Parenthood Southeast Advocates sued the state declaring the law, which bans nearly all abortions included in the cases of rape and incest, is unconstitutional. “The court is persuaded that the plaintiffs are likely to succeed in showing that the Act violates an individual’s constitutional right to obtain a pre-viability abortion, and thus that it violates her constitutional rights,” Thompson said in his order for a preliminary injunction.
District Judge Myron Thompson was appointed by Jimmy Carter. This is the same Judge that stopped Alabama from defunding Planned Parenthood back in 2015.
